摘  要:非典型劳动者在我国劳动力市场中普遍面临不稳定就业的困境。由于立法和司法上多种因素的制约,平等保护原则难以充分解决非典型劳动者的就业困境。基于劳动者就业发展权、倾斜保护理念以及打击隐蔽雇佣关系的需要,立法应当赋予非典型劳动者更为积极的就业转换权,以帮助其突破劳动力市场的分割。为落实这一权利,立法应当在劳务派遣和非全日制用工制度中,明确用人单位的相关义务和就业转换的相关情形,并加强对非典型劳动者职业培训权利的保护,从而确保非典型劳动者能够获得标准就业的机会。The plight of employment of the atypical workers has been concerned by the governments. Although the equal treatment principle is a measure to deal with the problem,it cannot resolve the plight effectively because of the default of the legislation and law enforcement. Based on the development right of employment,the idea of inclined protection,and combating the shadow employment,the right of employment transition should be endowed to the atypical workers to help them to break the division of the human resource market. The right consists of the application to transforming employment,the mandatory employment of transformation,the abatement of nuisance of the employment transition. To realize the right,the law should clearly define the obligation of inform of the employer and the statutory circumstances of employment transition,and enhance the right of vocational training of atypical workers,thus the opportunity of stepping into the standard employment of atypical worker can be guaranteed.
