摘  要:页岩气是一种致密非常规天然气,开发页岩气使用的水平钻井与水力压裂等关键技术会损毁土地,其引发的土地侵权可分为内生性土地侵权与外溢性土地侵权等类型,导致土地资源的物理结构性破坏、功能性破坏与依附于土地资源的财产损害。我国法律体系主要采用责任规则救济受到侵害的国家土地所有权,混用责任规则与财产规则救济受到侵害的集体土地所有权,仅适用赔偿损害责任救济其他主体土地权益。管制模式下的矿业权主体土地侵权行为规制思维与路径体现我国将稀缺土地资源向矿产资源开发领域的倾斜配置,导致诸多弊端,应重回侵权责任法律规则来解决矿业权行使中的土地侵权纠纷。Shale gas is an unconventional tight gas whose development may result in infringement cases of land rights,including both the endogenous land-rights infringement and the overflow landrights infringement,due to the uses of such technologies as horizontal drilling technology and hydraulic fracturing technology that will result in the damage to the physical and functional structures of the land resources and the land-related properties.The relevant law in China mainly uses the liability rules to remedy the state-land ownership,or use both the liability rules and the property rules to remedy the collective land ownership,only applicable to the compensation for damages to the land rights of other subjects.The ideas and approaches for the land-rights infringement related to mineral rights under the control pattern reveal a partial tendency that scarce land resources are offered often to the development of the mineral resources,which lead to quite a few bad consequences.It is suggested that infringement cases of land rights related to the execution of mineral rights should rely on the liability rules in the relevant laws.
