上海城市管理立法问题探索

摘　　要：当前,我国大多数城市的城市管理体制还不成熟。近年来,上海制定了一系列城市管理的地方性法规和规章,但随着城市的进一步发展,这些法规和规章的效果却越来越不尽如人意。本文通过研究和分析,发现目前上海城市管理立法主要存在法律规定部分条款执行性不强、执法方式比较单一、城市管理联合执法需求增大、城市管理执法人员缺乏执法保障等问题。应结合国内外城市管理的经验,从明确上海城市管理的总定位、打造新时期上海城市管理法规体系、及时转变政府管理职能应、建立高效综合的城市管理体制、完善城市管理执法的法律保障、探索多元化城市管理模式方面提出完善上海城市管理立法建议,以期对我国其他城市管理立法有所启发。The city management systems in most China＇s cities are still not mature. In recent years, Shanghai has formulated a series of local regulations on city management; however, the effects of those regulations are becoming farther from satisfactory, with the further development of the city. Researches concerned demonstrate that the legislative problems of Shanghai city management persist mainly in the weak enforcement of the provisions of the law, the relatively simple mode of the enforcement, the increased demand for joint law enforcement in city management, the lack of the protection of the law enforcement offcers, and the like. Finally, combined with city management experiences at home and abroad, the paper puts forward some suggestions, and expects to have some implications for the legislations of city management in other China＇s cities. Those suggestions include making clear the general orientation of Shanghai city management, establishing Shanghai city management law system under the new period, changing government management functions in a timely manner, establishing an efficient and comprehensive city management system, perfecting the legal guarantee of city management law enforcement, exploring diversified city management models, and so forth.
