摘　　要：推行环境污染第三方治理是我国环境管理制度改革的重要举措。文章以西部生态脆弱区为研究对象,运用理论分析、规范分析以及比较分析等方法,探讨了西部生态脆弱区特性,从法律理论基础、经济学理论基础以及实践基础三个层面阐述了环境污染第三方治理基础。文章基本结论是西部生态脆弱区环境污染第三方治理存在政企关系扭曲、责任不清、第三方治理市场与主体不足、监管不力以及市场准入与退出机制未建立等问题,通过建立与健全责任分担机制、加强与完善环保监督机制、构建与发展经济激励机制以及改进与推进市场化机制保障第三方治理的顺利实现,实现西部地区生态与经济协同发展。Third-party implementation of environmental govemance reform is an important measure of our environmental management system. Taking ecologically fragile western region as the study target, by using theoretical analysis, normative analysis and comparative analysis, the paper explores the characteristics of ecologically fragile western region, from a legal theoretical basis, basic economic theory and practice based on three levels of environmental pollution and then it expounded the tripartite governance foundation. The basic conclusion is that the western ecologically fragile area of environmental pollution control third-party relationship exists between government and enterprises distorted, unclear responsibilities, lack of third-party management and the main market, lack of supervision and market access and exit mechanism to establish position and other issues, by establishing a sound responsibility sharing mechanism, strengthen and improve environmental monitoring mechanism, construction and development of economic incentives and improving and promoting the smooth realization of market-based mechanisms to protect third-party governance to achieve ecological and economic coordinated development of the western region.
