刑事证人出庭难的原因及对策

摘　　要：十一届全国人大五次会议中对刑事诉讼法进行了修订,对有关证人出庭作证部分也进行了修改与补充,但由于传统理念等对国人的影响,立法中很多的不足,司法执法等方面的缺陷,证人保护制度的不够完善,实践中证人出庭难的问题仍居高不下。完善立法中的相关问题,提高对证人的保护;司法执法中,改变司法人员陈旧的观念,对其加以严格要求,特别注意要使立法中对证人的保护得以落实,从而使证人敢于出庭作证。法庭需要证人,诉讼正义和社会正义的发展需要证人,因此,新刑诉中关于证人制度的修改与补充现在仍值得我们关注。In the five session of the Eleventh National People＇ s Congress on the criminal procedure law was revised in the witness also part of the amendment and supplement, but due to the influence of traditional culture on Chinese people, many of the deficiencies in legislation, law enforcement and judicial defects and other aspects of the witness protection system is not perfect, practice difficult problem in witness remain high under. To improve the relevant legislation, improve the protection of witnesses in the judicial, law enforcement, improve judicial personnel outdated concept, strict requirements on its pay special attention to the witness protection legislation can be implemented, so that the witness dare to testify.The need for witnesses, litigation justice and the development of social justice requires witnesses, therefore, the amendment of the system of witnesses in the new lawsuit is still worthy of our attention.
