摘 要:连某某诉臧某某排除妨害纠纷案引起广泛争议,判决依据颇受诟病。如果将"非基于真实权利人意思而丧失不动产登记簿上权利归属的不动产"类似适用占有脱离物一定时间不发生善意取得的规定,可使本案"合情合法"也将系争房屋判予臧。通过列举发现,传统民法认为占有脱离物仅指非基于真实权利人的意思而丧失占有的动产,不适用于不动产。从法理逻辑结构上看,脱离物包含不动产是十分必要的;从现实可行性来说,使占有脱离物包含不动产并不违反现今占有脱离物一定时间不发生善意取得的立法目的。The Case of removing nuisance of Lian v. Zang caused widespread controversy,the judgment basis is quite criticized ifthinking, " not based on the real rights mean the loss of real estate register of rights of real estate" for similar uncommissionary possession for a certain period of time without provisions of bona fide acquisition,can make the casehousing department " lawfully" awarded to Zang. Through the list,found that the traditional civil law holds that possession does not apply to immovable property which is not based on the meaning of the real owner,but does not apply to immovable property.So the lack of treatment is self-evident. From the legal logic structure,the material including real estate is necessary,as far as practical feasibility is concerned,it is not in violation of the legislative purpose that the possession of the property from the possession of property does not violate the right of bona fide acquisition of the possession from time to time.
