《残疾人权利公约》的“合理便利”理念在我国教育领域的运用

摘　　要：合理便利是《残疾人权利公约》的一个关键概念。该公约对中国生效以后,中国在教育领域实施合理便利方面有了突出进步。行政机关在实施合理便利方面发挥了重要影响。2015年4月21日教育部和残疾人联合会联合发布的《残疾人参加普通高等学校招生全国统一考试管理规定(暂行)》要求为残疾人参加高考提供合理便利,这也是"合理便利"概念第一次明确正式出现在中国的规范性法律文件中。2017年1月11日国务院修订通过的《残疾人教育条例》规定了为残疾人参加国家教育考试提供合理便利的条款。在融合教育推进的过程中,在教育的每个环节,都可能产生大量的关于提供合理便利的需要。这就要求中国法律能够将提供合理便利从考试这一环节扩大到残疾人教育的所有事项和所有环节,并明确规定不提供合理便利构成歧视。＂Reasonable accommodation＂ is a key concept of the Convention on the Rights of Persons with Disabilities. After this Convention came into force in China, the state has made outstanding progress in implementing ＂reasonable accommodation＂ in the field of education, while the executive branch played an important role in it. The Provisions on the disabled persons to participate in the National College Entrance Examination （provisional）, jointlyissued by the Ministry of Education and China Disabled Persons＇ Federation on April 21, 2015, requires relative branches to provide reasonable accommodation in NMET for the disabled persons, which is the concept of ＂reasonable accommodation＂ for the first time explicitlyappeared in ! China＇s normative legal documents. Furthermore, on January 11, 2017, the Regulations on the Education of the Disabled, adopted by the State Council, stipulated that reasonable accom- modation shallbe provided for persons with disabilities while participating in NMET. There is a great deal of demand to provide reasonable convenience in the process of integrating education and in every aspect of education. And it requires to extend the ＂reasonable accommodation＂ from examination to all aspects and other matters of education for the disabled persons and ex- plicitly stated that reject to provide reasonable accommodation isa kind of discrimination in Chi- nese laws.
