摘  要:残疾儿童拥有平等受教育权利,是联合国《儿童权利公约》、《残疾人权利公约》、我国《宪法》和有关法律法规等明确确认的,体现社会的公平正义。近十年来,我国残疾儿童受教育权实现水平稳步提高,但依然存在受教育机会权利和改善受教育条件的权利发展不均衡的现实困境。政府需从财政投入、师资保障等方面积极履行法律规定的义务,供给更为精准的教育服务,并加强检查与监督,提供畅通的司法救济,破解残疾儿童受教育权利实现的结构性困境,维护残疾儿童平等受教育权利,促进教育公平。Children with disabilities have equal fights to education. And it's explicitly acknowledged by the Convention on the Rights of the Child, Convention on the Rights of Persons with Disabilities, the Constitution of the People's Republic of China and relevant laws and regulations, which embodies the fairness and justice of society. Over the past decade, the realization of fights to education of children with disabilities in China has steadily improved, but there are still real difficulties in realizing the balance of educational opportunity and educational conditions. The government shall actively fulfil its obligations from several aspects, including financial investments and guarantees of teachers. It shall provide more accurate educational services, strengthen inspections and supervisions, provide smooth way of judicial relief, crack down on the structural dilemma of realization of fights to education of children with disabilities, protect equal fights to education for children with disabilities and promote educational equity.
