摘　　要：邪教组织犯罪不仅给人类生命安全造成严重威胁，而且给社会秩序与财产安全招致巨大破坏，是当下社会的公害和毒瘤。由于邪教组织犯罪立法用语的模糊性以及部分设置的不合理性，如未对组织、领导邪教组织犯罪等预备行为有效防范，未将传播邪教、控制他人思想等实行行为科处刑罚，未引入特殊措施避免未成年人误入歧途等，导致依赖立法所寄望的预期效果难以实现。基于此，在厘清现存主要问题的基础上，借鉴域外规制此类犯罪法律制度之精粹，针对性地提出切实可行的立法完善对策，已然成为刑事法治妥善治理的有效路径．Not only cultic organization crime is a serious threat to living being safety, but also enormous damage to the social order and property security, as hazards and cancer to the present society. Due to the legislative language is fuzzy and some parts are unreasonable, for example, the preparing behavior of organization and leadership have not been effectively guarded against, the completing act of spreading cult and manipulating minds have not been punished by criminal penalty, not having introduced special measures to prevent the juveniles going astray, and so on,leading to the expected effect relying on legislation is difficult to achieve. Given this, on the basis of clarifing the main problems, mirroring the essence of legal system of such crimes from other countries,putting forward the feasible legislation consummation, is turning into the effective path of criminal law.
