摘 要:GATT/WTO多边贸易体制下"协商一致"决策方式的关键环节在于议案被"表决"前的谈判阶段。长期以来,GATT/WTO的谈判遵循"权力导向"路径,发达国家主导从议题拟定到谈判、再到议案产生的整个过程。实践中,"绿屋会议"、"主要供应国原则"和"一揽子承诺"等模式成为发达国家在谈判中推行的重要规则,但是它们在参与度、透明度和效率方面上存在明显缺陷,尤其是对发展中国家成员不利。WTO应该在现有实践的基础上改革和建构更加公平合理的谈判规则,才能更好的解决当前WTO僵局,从而推动多边贸易体制继续向前发展。The key point of "Consensus" of GATI'/WTO multilateral trading system is the negotiation stage before bill is submitted to a vote. For a long time, GATF/WTO negotiations have followed the "power-oriented" path, and the developed countries have dominated the whole process from the formulation of the negotiation issues to the negotiation and to the formation of the bills. In practice, the " Green Room", the "Principal Supplier Principle" and "A single undertaking" have become important rules adopted by developed countries in the negotiations, but there are obvious defects in their participation, transparency and efficiency, particularly for developing country members. The WTO system should reform and construct fairer and more reasonable negotiation rules on the basis of existing practice, so as to solve the current WTO stalemate, thus promote the continued development of multilateral trading system.
