检察机关驻公安派出所检察室刑事侦查监督运行机制研究——以南充市顺庆区人民检察院驻公安派出所检察室刑事侦查监督为例

摘　　要：检察机关驻公安派出所检察室对公安派出所进行刑事侦查监督是贯彻党的十八届四中全会《决定》以及最高人民检察院关于开展对公安派出所刑事侦查监督改革试点《通知》的重要举措,是进一步推进司法改革,完善司法权力运行机制,创新检察监督的需要,具有刑事侦查监督的必要性与可行性。南充市顺庆区人民检察院驻公安派出所检察室在刑事侦查监督机制方面做了一定的探索,取得了一定的成效。但就全国范围的试点情况看,检察机关驻公安派出所检察室试点工作仍存在立法不足、意识不强、监督不力、信息不畅等问题。为此,必须确立正确的监督原则,创新监督运行机制,增强监督的责任意识和监督力度,实现检察机关驻公安派出所检察室刑事侦查监督的科学化、信息化、专业化,取得监督的实效。Procuratorial offices of public security police stations supervised by procuratorial organs are established for criminal investigation and supervision,which is an important measure to implement the ＂decision＂ of the fourth plenary session of the 18th CPC central committee and the ＂notification＂ of pilot reform made by the supreme people＇s procuratorate on supervising the public security police stations＇ criminal investigation.It is an urgent need to further promote the judicial reform,improve the judicial power operation mechanism and innovate the procuratorial supervision.It also has the necessity and feasibility of criminal investigation and supervision.In this aspect People＇s Procuratorate of Shunqing District in Nanchong does a certain exploration to the mechanism of criminal investigation and supervision and achieves some results.However,in light of the nationwide practice,the pilot work of procuratorial office still has some problems in lack of legislation,lack of awareness,poor supervision,poor information and other issues.Thus,we must establish the correct principles of supervision,innovate the operating mechanism of supervision,enhance the sense of responsibility and increase the impact of supervision to realize the scientization,informatiization and specialization of the criminal investigation supervision of the procuratorial office of public security police stations supervised by procuratorial organ and achieve the effective supervision.
