略论制度廉洁性评估在地方立法中的应用

摘　　要：对地方立法进行制度廉洁性评估既是源头反腐的需要,也是履行国际法义务的需要,地方立法的特点和程序也决定了有必要对其进行制度廉洁性评估。但在地方立法评估制度日益成熟的情况下,没有必要再另行设置一个无所不包的制度廉洁性评估体系,而是应当将其纳入常态化的立法评估制度之中,并落实专职预防腐败机构的职责,由其作为第三方来对地方立法进行专门化的独立的制度廉洁性评估。The anti-corruption review of local legislation, based on China＇s international obligation as well as the will to root out institutional corruption, is essential in improving the law-making procedure of local legislation. However, it is not quite necessary to adopt a new all-inclusive anticorruption review system besides the current fledgling legislation review system. A better alternative is to absorb anticorruption review into legislation review, while making independent anticorruption review the responsibility of special anti-corruption agencies.
