摘 要:自20世纪80年代我国提出"生态农业"至今,已经取得了不少成绩,促进生态友好型农业发展、建立农业可持续发展长效机制已成为全社会的共识。但是也要看到,发展生态农业仍然面临着诸多制约因素,其中生态农业基本法律制度的不健全、生态农业配套法律制度的不完善恐怕是最大障碍。加强生态农业法治建设,需要借鉴发达国家生态农业法制建设的经验,在构建生态农业立法体系、健全生态农业执法管理制度、完善生态农业相关法律制度等方面下功夫,这将为我国生态农业发展提供坚实保障,同时也对加快推进农业现代化建设、全面建成小康社会具有重要的推动意义。Ever since the proposal of "eco-agriculture" in the 1980s, China has made a lot of achievements, and it has become a consensus for the whole society to promote the development of eco-friendly agriculture and build a long term mechanism for agricultural sustainable development. However, eco- agriculture is still faced with many restraining factors, of which imperfect of fundamental and supporting legal systems might be the most serious one. To reinforce the construction of eco- agricultural rule by law, it is necessary to learn from developed countries' successful experience, and concentrate efforts on establishing eco-agricultural legislation system, improving management system of law enforcement, and perfecting relevant legal system. In this way, it will provide a solid foundation for eco-agriculture development, agricultural modernization and building a moderately well-off society in an all-round way.
