摘　　要：推行公共安全法律制度是构建社会主义和谐社会的重要内容,主要功能在于保障公民权益、促进社会稳定。其逻辑起点在于以人为本而非国家本位;制度本质在于政府职能的转变与保障人权。通过对公共安全制度推行实践中所遇到的困境进行科学合理的剖析,结合我国安保现状,以正确的思想理论为引导,以建立健全法律规范为保证,以调动社会积极性为基础,以独立有效的监督机制为标尺,从而完善公共安全法律制度,使其迸发出应有的制度活力。Implementation of public security legal system is the important content of building a harmonious socialist society, the main function is to safeguard the rights and interests of citizens, and promote social stability. The logical starting point is the people - oriented view, rather than the state - oriented view; System essence lies in the transition of the function of the government and protecting human rights. Through the public security system for the difficulties encountered in practice scientific and reasonable analysis, combined with the security situation in our country, in the correct ideological theory as the guide, to establish and improve the legal norms to ensure that, based on arousing the initiative of social, independent and effective supervision mechanism to scale, to perfect the legal system of public security, and makes it burst into life.
