欧盟法视域下的法治与自治——对欧足联“财政公平竞争”原则的思考

摘　　要：参阅大量文献,对"财政公平竞争"原则进行了法律分析,结果如下:"财政公平竞争"原则违反了欧盟法,以往主要运用判例法解决,在体育写进欧盟法律的情况下,这种做法将大为减少,当前游离于欧盟法外的该原则所引发的最大思考是法治与自治的关系问题。我国应该借鉴欧盟法律多元化治理职业足球做法。Aided by documents consultation,this paper gave analysis of financial fair play with the results being shown as follows： Financial fair play by UEFA runs against the EU law which used to solve sport problems through case law,a practice that under the condition of sport entering into the EU law,will be less popular. The financial fair play,illegally carried out,would lead to much reflection,such as relationship between rule of law and self-government. It is,therefore,of high need to draw on the experience of EU by using diversification method to govern the professional football.
