摘 要:同人小说在我国自古有之,20世纪90年代,我国现代意义上的同人小说逐渐出现,但是受到时代的限制,影响力有限,并没有引起广大读者的兴趣和法学工作者的重视。如今,同人小说作为一种新兴的小众文化,吸引了一批青年读者。同人小说是根据原著作品进行改编二次创作的演绎作品。早期的同人小说作者怀着对原著作品的热情创作作品,这种行为是无偿的。现在,某些同人小说因为商业利益的需要,进行营利活动。著作权法对演绎作品限制、原著作者与同人作者的利益冲突以及法律的不完善,导致了一系列的问题:同人小说作为演绎作品,其存在的合法性能否得到著作权法保护,该如何进行保护,同人作品在受到著作权法保护的同时如何协调与原著作品的关系,等等。In the 1990s, the novels of our country in the modern sense gradually appeared, but by the time limit, the influence of the same person's novel is limited, and did not cause the interest of the readers and the legal practitioners.
