摘 要:《国内水路货物运输规则》被废止后,沿海、内河货物运输法律适用问题日益突出。目前,《海商法》修改研究工作正式启动,是否扩大适用于沿海、内河运输是修改研究工作面临的主要问题。鉴于国内水路货物运输与国际海上货物运输在航运实践中存在着很大区别,且立法逻辑完全不同,为保持《海商法》第四章体例独立,建议将其改为"国际海上货物运输合同",专门调整国际海上货物运输;建议增设单章"国内水路货物运输合同",调整沿海及内河货物运输;在起草相关条文过程中要注意立法技术,处理好立法与其他法律渊源之间的关系。After the annulment of Rules on Carriage of Goods by Domestic Waterway,the problems have been becoming increasingly prominent concerning the application of laws to the coastal carriage of goods and the carriage of goods by inland waterway. At present,the project of the amendment to Maritime Code of the People's Republic of China has been officially launched,and whether to extend its application to cover the coastal carriage of goods and the carriage of goods by inland waterway or not is a main problem facing the amendment work. Given the important difference between carriage of goods by domestic waterway and international carriage of goods by sea in shipping practice and their total difference in legislative logics,and for the purpose of keeping the independent form of Chapter IV of Maritime Code of the People's Repulic of China,it is suggested to change its headings into"Contract of International Carriage of Goods by Sea"to regulate the international carriage of goods by sea,and to add another chapter entitled "Carriage of Goods by Domestic Waterway"to regulate the coastal carriage of goods and the carriage of goods by inland waterway,and further,during the drafting process of the relevant articles,attention should be paid to legislative technique so as to deal with the relationship between the legislation and other sources of law.
