彝族法律思维的定位及其价值

摘　　要：彝族法律思维是彝族人民在长期的经验生活中逐渐积累和变迁的在处理法律纠纷时所采取的模式或样式。其与宗教密不可分,具有法律思维之民刑一体及诸法合一性,彝族法律思维的根基是家支制度和德古制度。彝族法律思维中最为典型的是继承思维和纠纷解决思维。继承思维是彝族民事习惯法思维的重要组成部分,家支和社会等级在彝族的继承关系中扮演着重要的角色,彝族的继承思维主要遵循的是彝族地区的习惯法;在纠纷解决思维上,彝族传统型权威纠纷解决的影响力在现代社会中呈现下降趋势,而国家法律和国家正式解纷机构认可度正在提高,我们应当超越二元对立的法治思维,建立多元化的、分工明确的纠纷解决机制,必须重视传统和现代资源的整合。重视彝族法律思维,弥补国家法的不足,促进彝族地区的政治和经济发展。Yi legal thinking is the Yi people in the long experience of life gradually accumulate and change in dealing with legal disputes taken when the model or style. It is inseparable from the religion, with the legal thinking of the people and the unity of the law, the legal basis of Yi＇s legal system is the family system and the ancient sys- tem. The most typical of Yi legal thinking is inheritance thinking and dispute resolution. Inheritance thinking is an important part of the Yi people＇s civil customary law thinking. The family branch and the social hierarchy play an im- portant role in the inheritance relation of the Yi people. The inheritance thinking of the Yi people mainly follows the customary law of the Yi nationality area. In the dispute settlement thinking, The influential degree of the traditional dispute of the Yi people in the modern society is declining in the modern society, and the recognition of the national law and the national formal dissolution mechanism is improving. We should transcend the dualistic opposition to the rule of law and establish a wide and clear division of labor To solve the mechanism, we must attach importance to the integration of traditional and modern resources. It is helpful to make up the deficiency of the national law and promote the political and economic development of the Yi nationality region.
