摘 要:在新一轮的司法改革中,司法的地方化、行政化和机械化等法官管理制度中老生常谈的话题,又被重新提起并在改革措施中得到不同程度的解决。但是,从已经披露的资料来看,当前的改革措施解决这些痼疾的前景并不令人乐观。立足我国法治理论与实践,贯彻法治思维和法治方式、充分发挥司法的积极作用并有效解决诸多现实问题,是法官管理制度改革的必由之路。基于这种思路对我国法官管理制度进行革故鼎新,就应当干脆彻底地做到:基于法制统一的标准,建立全国一体的法官任免制度;基于司法原理的要求,废除干扰法官独立审判的制度;基于法官职业的特点,建立科学合理的法官保障制度。In the new round of judicial reform, the old problems of the localization, administration and mechanization of judicature have been brought up again and solved in varying degrees. However, from the information already disclosed, the current measures are not very promising in resolving these chronic diseases. The only way to reform the judicial management system is to keep a foothold in our theory an and practice, to give full play to d practice of the rule the positive role of ju lems. National judge appointment system should of law, to carry out the rule of law thinking stice and effectively solve the practical prob- be established according to the single criterion of rule of law. Regulations interfering in independent adjudication should be abolished according to the requirements of judicial principle. A scientific and reasonable judge security system should be established considering the occupation characteristics of judges.
