我国行政追偿制度的困境与出路

摘　　要：行政追偿制度是法治政府建设中的重要制度构成,其以推动公务人员正确履职和公民正当权益保障为价值取向,是对法治政府建设的有效回应。行政追偿制度的内部性是导致该制度难以真正落实的根本原因。故重新解读行政追偿的理论基础就在于突破其内部性的桎梏、构建行政追偿启动督促机制。针对未经诉讼的行政赔偿案件,行政赔偿义务机关将是否启动行政追偿的决定抄送监察委员会,由监察委员会对此提出监察建议;行政赔偿诉讼中,由人民法院对执法人员的行为进行司法审查,就是否启动行政追偿提出司法建议;权力监督机制常态化,在权力机关内部设立专门机构,接受行政赔偿受害人的诉求,是解除我国行政追偿制度困境的关键之举。The administrative compensation system is an important system in the construction of the government ruled by law, which is an effective response to the construction of the rule of law in order to promote the correct performance of civil servants and the protection of the legiti- mate rights and interests of citizens. However, the administrative compensation system is the root cause of the system is difficult to implement the root causes. The theoretical basis of re interpreta- tion of administrative compensation, internal break the shackles of the construction of administra- tive compensation; start supervision mechanism： for without litigation of administrative compensa- tion, the administrative organ liable for compensation will decide whether to start the administra- tive recoupmen CC Commission, by the Commission to recommend supervision; administrative compensation proceedings, the people＇ s court of law enforcement personnel the conduct of judi- cial review, we put forward a judicial proposal whether to start the administrative compensation; power supervision mechanism normalization, the establishment of specialized agencies in the in- ternal organs of power, accept the administrative compensation for the victim＇ s appeal is the key way to terminate the implementation of the system of administrative recounment dilemma.
