从全面取证到规范保管:侦查环节证据运用的法律规制

摘　　要：刑事证据的全面收集与规范保管是确保侦查质量,实现案件正确定罪量刑的基础,也是以审判为中心的诉讼制度改革的题中应有之意。就全面取证而言,需扭转传统办案思维,摘掉有色眼镜;需建立以法院为中心的司法体制;需重新划分警检各自权力范围,探索借鉴"检察引导侦查取证"制度。从规范保管的视角而言,需建立阶段性证据详细记录机制;建立证据调取的规范化机制;需保障证据保管的外部环境和支撑条件。当然,为切实保障犯罪嫌疑人的诉讼权利,依法贯彻无罪推定理念应当贯穿整个办案过程的始终。The comprehensive collection and standard keeping of criminal evidence is the basis of ensuring investigation quality and achieving the correct conviction and sentencing of the case, and the trend of the trial-centered litigation system reform as well. As for comprehensive evidence collection, it is necessary to establish the court-centered judicial system with investigators＇ transformation of traditional ideas, and also necessary to redraw the power spectrum of police organs and procuratorial organizations to explore the system of procuratorial work guiding evidence collection in investigation. As for standard evidence-keeping, it is necessary to establish the system of recording periodization evidence in detail, establish standardized evidence collection system and guarantee its external circumstance and supporting conditions. The presumption of innocence should be carried out throughout the process of handling cases to protect the rights of suspects.
