摘　　要：[目的/意义]针对引进国外数据库中的著作权相关问题,拟结合图书馆引进实践与知识产权制度、合同法、竞争法,提出综合应对策略,降低国外数据库引进工作的法律风险并维护图书馆自身合法权益。[方法/过程]将国外数据库引进中的著作权相关问题进行类型化分析,归纳出实践中的6大问题,包括国外数据库开发者与许可方可分离性引起的合同效力风险、著作权效力不稳定引起的合同履行风险、国外数据库商滥用著作权采取不合理的技术保护措施、制定无法实现信息长期保存功能的使用规则以及收取不合理的许可使用费、制定不合理的销售模式等。[结果/结论]针对上述问题,提出开展有针对性的著作权教育计划、制定图书馆国外数据库资源引进标准、注重长期保存许可的获得、选取集体性采购联盟模式并推动许可方的合理许可承诺、引入外部信任机制以及加强著作权风险管理等应对策略。[ Purpose/significance] In terms of the copyright issues during the introduction of foreign database, by integrating library practice with intellectual property system, contract law, and competition law, this paper puts forward comprehensive strategies to reduce the legal risks and to protect the legitimate rights of the library. [ Method/process ] The paper summarizes the related copyright issues during the introduction of foreign database into six types, including the contract validity problem, contract perform- ance risks, unreasonable technology protection measures, unfair application rules, licensing fees and sale model. [ Result/con- clusion] In view of the above problems and risks, the paper puts forward some suggestions for the foreign database introduction, which include carrying out targeted copyright education plan, setting the standard of introduction of foreign database, acquiring long-term preservation licensing, choosing collective procurement alliance mode to promote the commitment of fair license, introducing external trust mechanism, strengthening copyright risk management, and so on.
