论电视节目模板的法律保护

摘　　要：电视节目模板是系列电视节目制作的固定模式,其构成要素包括节目宗旨、节目形式、节目风格三部分。电视节目模板具有框架性、重复性、相似性、变动性的特点。电视节目模板的开发融入了工作人员的创造性劳动,应对其进行法律保护。但由于电视节目模板的价值源于创意,电视节目模板不能提供电视节目的具体内容,且电视节目模板的各构成要素变动不居,权利客体不明,因此电视节目模板不构成作品,不能获得著作权的保护。实践中买卖电视节目模板"版权"的行为实质上是对创新的电视节目模板所含创意的许可使用行为。电视节目模板虽不能达到著作权所要求的"独创性"条件,但创新的电视节目模板在构成要素上必具有"独特性",应获得《反不正当竞争法》的保护。我国的各地方电视台是具有直接竞争关系的经营者,可以适用《反不正当竞争法》的一般条款规制对电视节目模板的不当模仿。如果其他电视台对电视节目模板权利人的"模板"进行无创新地简单复制且复制的要素过多,即构成不正当竞争。但在保护电视节目模板权利人利益的同时,要考虑电视节目模板的投入成本、回收周期、消费者混淆可能性等具体因素,对电视节目模板的"不当模仿"作出正确判断,以保护竞争自由,促进电视行业的繁荣发展。TV program template refers to the fixed mode of series of TV programs and includes three parts,namely,objective,form and style. TV program template has the characteristics of framework,repetitiveness,similarity and mobility. The development of TV program template involves working staff＇s creative work and shall be legally protected. However,due to the lack of concrete content and the ambiguity in the object of right,TV program template can not be called finished products. As a result,it can not be protected by Copyright Law. Creative TV program template has the characteristics of specialty in framework and shall be protected by the Law against Competition by Inappropriate Means in order to protect the freedom of competition and accelerate the prosperity of TV industry.
