从占有意思角度重析善意取得制度

摘　　要：善意取得制度的成立应包括占有前提。占有分为占有体素和占有心素两个要素。其中,占有的心素指的是占有意思,其存在与否对于判断占有委托物和占有脱离物具有重要借鉴意义,尤其在欺诈、胁迫、重大误解等占有移转合意难以判断的情况下,占有意思的存在更是区分两者的关键。盗赃物应与遗失物一样,归属于占有脱离物。占有脱离物之外是占有委托物,善意取得的占有前提即体现为移转的标的物是占有委托物,但只满足占有委托物这个占有前提还不够,善意取得的其他要件也要成立。只有在占有前提和善意取得的其他要件均满足的情况下,善意取得才会真正成立。The establishment of a bona fide acquisition system should include a prerequisite. Possession is divided into possession of voxels and possession of the mind. Among them ,the possession of the mind refers to the meaning of possession. And its existence is an important distinction for the possession of entrusted objects and the possession of detached objects especially in the fraud, coercion, major misunderstanding which are difficult to judge the consensus of transferring. Under these circumstances, the existence of meaning is the key to distinguish them. Pirates of the stolen goods should be the same to the lost material, belonging to the possession of detached objects. Beside the possession of detached object is the possession of entrusted objects. The premise of the goodwill of the possession is reflected in the transferring of the possession of entrusted objects, but only to meet the prerequisite of the possession is not enough,other elements are also needed. Only in the premise of the possession and other elements of the bona fide acquisition system are satisfied, the goodwill made will really be established.
