摘 要:现有的成文法规定将我国劳资集体争议分为三种类型,即集体劳动争议、集体合同争议和集体行动争议。不同类型的集体争议,由于其性质特点的差异,其处理机制也有所不同。现行法律关于劳资集体争议的处理机制尚不健全,没有形成完整的统一体系。集体争议处理的核心是保障劳动者的集体权利,要以"劳工三权"即团结权、集体谈判权和集体争议权为基础,构建完整和系统的劳资集体争议规制体系。In view of the status quo of capital-labor collective disputes and the relevant laws,there are collective disputes of three types:collective labor disputes,collective contract disputes and collective action disputes.With their varying nature and characteristics,those types also differ from each other in their resolution mechanisms,which are not yet comprehensive or perfect,let alone having joined into a complete regulatory system.The core of resolution mechanisms of collective disputes is to protect the collective right of laborers.This author proposes that the construction of a complete and systematic collective disputes regulatory system must take as its base'three rights for laborers,'to be specific,right for solidarity,right for collective bargaining and right for collective disputes.
