摘 要:全国人大常委会《修法决定》中的"补偿奖励条款"对现有民办学校(2016年11月7日《修法决定》公布前设立)转设时的剩余财产处置规定了总体政策框架,但该条款在文字表述上的歧义致使地方在制定实施意见时产生了普遍的理解偏差。通过对这些偏差进行合法性与合理性的深入讨论,得到以下基本结论:第一,获得"补偿或者奖励"是现有民办学校的普遍权利,与他们在新法实施以后的选择无关;第二,制定"补偿或者奖励"的地方政策必须完整体现《修法决定》关于主要因素的规定;第三,必须把民办学校历年培养的学生(毕业生与在校生)作为衡量现有民办学校办学效益的主要因素。The Compensation or Awarding Clause of the Law-Amending Decision made by the Standing Committee of National People's Congress regulates the general policy framework for the existing non-governmental schools' (established before the publication of Law-Amending Decision on November 7th, 2016) disposal of surplus property during their transformation. However, due to the literal ambiguity of the Compensation or Awarding Clause, local governments have different comprehending deviations when enacting implementation suggestions. Based on in-depth discussion on the validity and rationality of these comprehending deviations, this thesis draws the following conclusions: firstly, to get compensation or awards is the general rights of non-governmental schools, which has no relations with their choices upon the implementation of the new law; secondly, local governments that enact compensation or awards policies shall fully match the regulation of the main factors of the Law-Amending Decision; thirdly, the performance of non-governmental schools shall be evaluated mainly based on their students, including both graduates and enrolled students.
