摘 要:虽然现行教育法规确认了高校处分违纪学生的裁量权,但在实务中陷入失范困境,管教功能弱化。裁量权的行使偏差突出表现为:滥用裁量偏离育人本位;瑕疵裁量降低管教效率;正当裁量难获司法尊让。主要原因包括:高校教工缺乏正当行使裁量权的法治意识;高校学生违纪处分的法制建设不充分;司法裁量权的过度行使侵蚀学术自治权。为规范高校裁量权的行使,建议提高高校内部学生违纪处分制度的司法化程度,将司法审查限定在形式合法性审查范围内,将司法鉴定制度或专家辅助人制度引入司法诉讼。Although educational laws and regulations have confirmed that higher education institutions have the discretionary power in student discipline, the practice of discretion in this area is trapped in a dysfunctional dilemma. The abuse of discretion leads to a deviation from the purpose of education; the defective exercise of discretion weakens the disciplinary function; the proper exercise of discretion can hardly gain judicial respect and compromise. The reasons are summarized as follows: the faculty and staff in higher education institutions lack the sense of rule of law in the proper exercise of discretion; the student disciplinary system is incomplete in higher education institutions; the overuse of judicial discretion erodes academic autonomy. The paper puts forward several proposals to regulate the use of discretion in student discipline.
