论高校处分违纪学生之裁量权的行使偏差

摘　　要：虽然现行教育法规确认了高校处分违纪学生的裁量权,但在实务中陷入失范困境,管教功能弱化。裁量权的行使偏差突出表现为:滥用裁量偏离育人本位;瑕疵裁量降低管教效率;正当裁量难获司法尊让。主要原因包括:高校教工缺乏正当行使裁量权的法治意识;高校学生违纪处分的法制建设不充分;司法裁量权的过度行使侵蚀学术自治权。为规范高校裁量权的行使,建议提高高校内部学生违纪处分制度的司法化程度,将司法审查限定在形式合法性审查范围内,将司法鉴定制度或专家辅助人制度引入司法诉讼。Although educational laws and regulations have confirmed that higher education institutions have the discretionary power in student discipline, the practice of discretion in this area is trapped in a dysfunctional dilemma. The abuse of discretion leads to a deviation from the purpose of education; the defective exercise of discretion weakens the disciplinary function; the proper exercise of discretion can hardly gain judicial respect and compromise. The reasons are summarized as follows： the faculty and staff in higher education institutions lack the sense of rule of law in the proper exercise of discretion; the student disciplinary system is incomplete in higher education institutions; the overuse of judicial discretion erodes academic autonomy. The paper puts forward several proposals to regulate the use of discretion in student discipline.
