摘 要:近些年,投资条约仲裁已经越来越多地被投资者当作强有力的工具用来挑战广泛的东道国管理措施。本文以Philip Morris公司与澳大利亚和乌拉圭的投资仲裁为例,探讨了东道国对WTO法律的违反构成对FET标准的违反的可能性;分析了WTO和投资仲裁间的管辖权重叠或管辖权冲突可能会导致WTO法律体系碎片化的风险;通过考察BIT背景下投资保护与其他国际条约相关条款,指出WTO成员应发展更有效的规则以防止WTO法的整体性在投资条约中遭受来自投资者的过度干涉。In recent years, investment treaty arbitration has been increasingly used as a strong instrument by investors to challenge the extensive host state reg- ulatory measures. Using Philip Morris' s investment arbitration against Australia and Uruguay as illustrative examples, this paper explores a possibility that host state' s violation of WTO law would establish violation of the FET standard, analyzes the risk of fragmenta- tion confronted by WTO treaty system which is resulted from jurisdictional over- lap or jurisdictional competition between the WTO and investment arbitration. Based on the reviews of certain clauses relating investment protection to other in- ternational agreements in the BIT context, we point out that WTO members should develop more efficient rules to safeguard the integrity of WTO law from undue interferences by investors in their investment treaties.
