论外贸代理制“权责均衡化”的制度设计

摘　　要：《对外贸易法》存在着很大的缺陷,仍然难以和国际代理制度接轨,很难融入国际贸易代理的大潮流中。外贸代理中出现诸多的问题,是由于我国外贸代理法规不健全和外贸代理制度不完善造成的。当事人权利义务分配的不合理不符合代理制度设置的本意。由于对外贸易方式越来越呈现出多元化和多样性,原来的法律法规已经不能满足这一变化,必须完善相关的规则设计。The Foreign Trade Law still has some severe defects,it is still very difficult to connect it with International agency law,it cannot not easily be connected with integrated into the tide of international trade agency.Many problems in the trade agency show that the problems appeared in this trade agency is because our Foreign Trade Agency is unsound and the rules of the foreign trade agency is imperfect.The unreasonable distribution of the party＇s right and obligation doesn＇t accord with original intention of agency system.Since the foreign trade shows more and more pluralism and diversity,the present laws or rules cannot meet the needs of the change,we must perfect the related design rule.
