人格刑法理论视域下终身监禁的裁量因素分析

摘　　要：终身监禁是在我国新形势下兼顾"少杀、慎杀"与"严惩贪腐"的一项具体刑事政策,它是以判处死刑缓期执行为前提,以不予减刑、假释的无期徒刑为内容的新举措。其与死刑立即执行、死刑缓期执行之间的刑罚界限问题,须注焦于犯罪人的内部特征,以行为人的反社会性人格强弱与改造可能性大小为裁量依据。立于行为背后的人格才是责任非难的对象,而人格之形成乃系全部生活经历之结果,具体应考察犯罪人性格、成长经历及境遇、一贯表现等人格因素,从而发挥其在重大贪污受贿犯罪中的刑罚裁量作用。Life imprisonment is a new measure for bribery and corruption crime under the policy of'cautious and temperate death penalty'and'severe punishment of corruption'.Premised on a death sentence with a two-year repriever,it is essentially a life imprisonment without reduction of sentence as well as parole.Its adjudication of punishment is different from the immediate execution of death penalty and the death sentence with repriever,which is focused on internal characteristics of the criminals,especially the level of antisocial personality and the possibility of criminal reform that come from the facts of pre-crime and behavior of post-crime.The personality that stands behind the behavior is reprehensible,and a man's daily life experience contributes to building up their personalities.Therefore,the paper suggests that evaluations of the criminals'personalities such as their dispositions along with their consistent performances,personal experience,rescue efforts and so on can play an important role in the practice of punishment of bribery and corruption.
