公产法视角下的公务用车制度改革——以F省第一轮公车改革实施情况为例

摘　　要：公务用车的法律定位是行政公产。从F省第一轮公务用车制度改革的实施情况看,公务用车在设置上存在目标模式偏差;在使用上欠缺行政效能,适用事项和程序不清;在管理上具体规定和配套制度乏力,共享平台建设薄弱;在监督上仅限于内部监督,未能形成完善的监督体系。进一步推进公务用车制度改革,需要规范化、制度化的法律给予支撑。为此,建议明确公务用车制度的设置方式和程序,确立科学合理的设置制度;遵循合法、不违背设置初衷和最佳使用的原则,形成高效便捷的公车使用制度;加强"公物仓"建设,健全规范严格、资源整合良好的管理制度;加强事前事中事后监督,建设全方位、全过程的监督制度。Government public vehicles are legally positioned as administrative public properties.Seen from the implementation of the 1 st reform of the government public vehicle-using system in F Province,government public vehicle-using system is deviated from the target mode on the settings;lacks administrative efficiency in practical use without clear applicable matters and procedures;is weak in specific provisions and supporting system for the management with a poor shared platform construction;and are limited to internal supervision without a perfect supervision system.Therefore,it＇s recommended to clarify the setting mode and procedures,thereby establishing a scientific and rational setting system;follow the principle of law-abidingness,goal-orientation and best use,thereby forming efficient and convenient system of use;strengthen the construction of ＂public property warehouses＂,ensuring a management system with sound and strict norms as well as a good integration of resources;and strengthen the pre,in and post supervision,constructing an all-round and whole-process supervision system.
