融合技术条件下国际条约对广播组织权保护问题研究

摘　　要：现行国际条约中有关广播组织权保护的只有三个,分别是《罗马公约》《布鲁塞尔卫星公约》《与贸易有关的知识产权协议》,而由于这三个国际条约签订时信息传播技术水平有限以及立法观念的非开放性,造成它们面对先进的融合技术时呈现出不同程度的历史局限性。为了弥补国际条约所存在的不足,迎接流媒体技术所带来的挑战,完善广播组织权保护制度,SCCR连续召开了26届相关会议,历经了网络广播的概念的提出、另立程序的保护方案、保护广播组织网络播送被列入审议清单三个认识阶段。有关广播组织的网络传播保护,无论是强制性方案还是可选性方案,已获得大会的谅解,开启了第四个阶段的征程。There are only three international treaties in the protection of broadcasting organizations,namely,Rome Convention,Brussels Satellite Convention and Agreement on Trade-Related Aspects of Intellectual Property Rights.Their limited level of dissemination technology and non-openness of the legislative concepts come across advanced fusion technology.The SCCR has held 26 related conferences,calling for separate program protections.The protection of network communication of broadcasting organizations,whether mandatory or optional,is recognized by the General Assembly that has launched the fourth phase of journey.
