村民自治制度法治化运作的障碍探析

摘　　要：村民自治制度的民主内涵、发展目标和主要任务,提出了法治化运作的必然要求;我国法治理论和依法治国实践的深入发展,奠定了村民自治制度法治化运作的基础。当前涉及村民自治的法律规范还存在纵向体系有漏洞、横向体系覆盖不全的问题,法律主体的不成熟和法律程序的不完善增加了法律实施的困难,部分村民法律意识淡漠侵蚀着村民自治制度的基础。The legalization should be carried out on the basis of the democratic connotation, the development goal and the main task of the villager autonomy system. The further development of the theory of rule of law and the the incomplete coverage of the horizontal system. Besides, the immaturity of the legal subject and the imperfection of the legal procedure increase the difficulty of the enforcement of the law. Furthermore, the indifference of villagers＇ legal consciousness erodes the foundation of villager autonomy system.
