民法典编纂背景下的宗教财产权属地方立法研究

摘　　要：我国宗教财产权属纠纷以财产归属及相关权益为争议点。基于我国宗教财产权属不明晰与宗教财产保护制度缺失的现状,为解决宗教财产所有权归属及相关权益问题,完善宗教法人制度具有必要性与可行性。赋予宗教团体以社团法人资格,宗教活动场所以捐助法人资格,将宗教财产所有权及相关权益归属于宗教法人所有,建立宗教财产监察人制度,完善宗教财产使用监督机制。通过探索地方立法对建立与完善宗教法人制度的研究,为民法典编纂中宗教法人制度与宗教财产的管理与保护提供理论支撑与实践经验,使宗教财产依法得到保护,引导宗教组织更加积极合法地开展宗教活动。Disputes over the ownership of religious property in China are related to property ownership and other relevant interests. Owing to the unclearly-stated religious property rights and the deficiency in religious property protection system in China, it is imperative and feasible to better the religious legal person identifying system in order to solve the problems of the ownership and other relevant rights and interests of religious proper- ty. To better the system, we should first entitle the religious bodies to the legal person status of the public insti- tutions and organizations, the sites for religious activities to legal person status of donation, and the religious property ownership and related fights to the religious legal persons. Secondly, we should improve the religious property supervision mechanism by establishing an inspection system. By exploring how the local legislation studies the establishment and improvement of the system identifying religious bodies as legal persons, the author expect to provide theoretical supports and practical experience for religious bodies legislation and the management and protection of religious property in the process of compiling The Civil Code, and consequently the religious property ownership rights can be properly protected and guidelines can be offered to the religious bodies which will become more dynamic in organizing lawful religious activities.
