摘　　要：我国《刑法》第234条之一规定的组织出卖人体器官罪,为遏制和惩罚买卖人体器官的犯罪行为提供了相应的刑法依据和罪刑标准。这一罪名的设置体现了罪刑均衡原则,符合国际化趋势。我们将从司法实务层面,对组织出卖人体器官罪的法律适用进行简要的探讨。The China＇s criminal law stipulates the organization of the crime of selling human organs, and provides the corresponding criminal law basis and the standard of crime and punishment in order to curb and punish the criminal acts of buying and selling human organs. The establishment of this accusation embodies the principle of balance between crime and punishment and conforms to the trend of internationalization. This paper discusses the application of law to the crime of organizing the sale of human organs from the judicial practice level.
