预算公开法律制度的法理基础、现实困境与规范进路——以预算知情权分析框架为切入点

摘　　要：以公民预算知情权分析框架为切入点与逻辑主线,考量当前预算公开法律制度从预算知情义务主体和权利主体两方面分析,存在人大代表预算监督机制缺陷、普通民众民主观念淡薄,对预算公开的参与度低的现实困境,并以公民预算知情权之实质实现为目标,论证理论层面的预算公开行为的控权法与授权法规范进路。Taking into account the realistic dilemma of the legal system of budget disclosure,this paper takes the framework of citizens＇ right to know government budgets as the starting point and logical main lines,and analazes the subjiect of obligation and the subject of right. The result shows the realistic dilemmas such as shortcomings of the budget supervision mechanism of the NPC deputies,weak public democratic ideas,and inefficient participation to the open buget,etc. Aiming to the realization of citizens＇ right to know,this paper demonstrates the theoretical budgetary behavior of the controling law and the authorization law.
