摘 要:我们所处的社会由于自身系统制造的危险而身不由己地突变为风险社会,尤其是环境风险由于危害大、频率高更应该成为防范的主要对象。而环境刑法法益作为预防重大环境问题出现的社会最后一道防线,也应该对风险社会有所因应,发挥"控制风险,降低风险,恢复环境"的刑法机能,但是现行的环境刑法法益立法未能有效实现上述机能,因此需要改革环境刑法法益的保护现状以适应风险社会的要求,在实现途径上强调重构环境刑法法益的内容体系,通过环境刑法正当性程序的适用使环境刑法法益能够得到准确、有效的保护,以及设置以环境刑法法益恢复为主要内容的环境刑罚,从而使得环境刑法法益在风险社会中得到保护。Because of the risk of manufacturing system itself, our society has changed into risk society. Especially the environmental risk should be the main object of prevention. The environmental criminal law benefit should be the last line of defense as to preventing major environmental problems. It also plays the role of reducing and controlling the risk and the restoration of the environment. However, the current environmental criminal law benefit legislation can’t effectively achieve the above functions. Therefore, it is necessary to reform the current situation of the protection of the legal interests of the environment criminal law to meet the requirements of the risk society. We need reconstruct the content system of environmental criminal law benefit and protect the interests of environmental criminal law through the application of the legitimacy procedure of environmental criminal law. In addition, we need set up the environmental penalty with the restoration of the environmental criminal law benefit as the main content, thus enabling the environmental criminal law benefit to be protected in the risk society.
