户外运动和户外救援分类适用法律模式的研究

摘　　要：采用文献资料法、访谈法、个案法、实地调研和逻辑推理的研究方法,对户外运动和户外救援所适法律进行系统研究。按体育比赛项目、俱乐部组织项目和自由行三类将所发生意外伤害进行了法律归责刨析,以组织者、受害人和受益人的责任构成判定体育侵权案件的性质和责任分担及是否需承担赔偿责任。建议高层立法或在《体育法》修订时加入具有高危性质的户外运动伤害条款,强化户外运动俱乐部监督管理,加强舆论正确导向,牢固树立安全意识,促进我国户外运动的健康发展。A systematic study is made on the law of the classification in outdoor sports and outdoor rescue by using the methods of literature review,interview,case study,field investigation and logical reasoning. Legal liability is analyzed in 3 occasions of sport events,club organized events and free stroke. The liability nature of organizers,victims and beneficiaries are used to determine the nature and responsibility of sports tort cases,as well as if compensation liability should be assumed. It is suggested to execute high level legislation or add high risk of outdoor sports injury provisions when revising the ' sports law ',to enhance the supervision and management on outdoor sporting clubs,to strengthen the correct guidance of public opinion,and to establish a sense of security firmly,in order to promote the healthy development of outdoor sports in China.
