摘 要:禁止官吏经商,既关系到遏制官吏腐败、保持社会政治稳定,又关系到社会经济的健康发展,所以是一个极为重要的问题。中国历代封建统治者对此相当重视。唐代吏治立法有相当高的成就,吏治成为整个法制的重要组成部分,在规范管理官吏的系列法律中,其对打击官吏经商谋利的规定相当严密:禁止官吏及工商业者相互兼业,惩治官吏通过代理人经营牟利或于辖区内非经常性买卖得利,限制和打击官吏一定范围的亲属经商及非经常性买卖谋取剩利。唐律的这些规定启示我们:我国现行禁止官员及其家属经商的法律规定应明文化、系统化,并加大对官员家属利用官员所处的权势地位经商行为的处罚力度。Banning government officials from engaging in trade is of great significance, because it plays an im-portant role in preventing corruption, and in keeping social stability and the healthy development of economy. The feudal dynasties of past ages attached great importance to it. The administration of officials was a big part of the legal system and achieved great success in the Tang dynasty. Of the sense laws administrating government officials, the order of banning them from engaging in trade was compact and rigorous: the banning of government officials and their relatives from engaging in trade and vice versa and punishing officials and their relatives who gained profit through agents or infrequent profit from trade in the area under their jurisdiction. The rules in the Tang dynasty pose us some enlightenment: the present banning for government officials and their relatives from trade should be systematized and stipulated in explicit legal terms, and punish severely their relatives in trade who make use of the power of the officials.
