“单位人”与“乡村人”居民法治文化的冲突与融合

摘　　要：资源型小城镇中"单位人"和周围农村的"乡村人"的法治文化基础存在较多不同,他们的法治思维方式存在差异,对待组织和个人关系的认知上有较大区别,在出现纠纷之后的解决方式上存有较大区别,产生法治文化需求的行为及数量也存在较大差别。解决他们之间的冲突,特别是在"社区人"的共同居住格局下,需要尽快实现以资源型小城镇建成区为依托的现代小城市建设,将"单位人"和"乡村人"身份标签逐步过渡到"社区人"的统一表征。同时,实现公民意识下的市民与宗法观念下的族人融合,并加快开展法律普及工作,积极传播法律知识,形成法律资源供应的蓄水池,解决法治需求与法律资源供给之间的矛盾。此外,还要发挥特定人群的特殊作用,为居民法治文化培育提供人才保障。There exist a lot of differences in law culture foundation between ＂unit people＂ in resource-based small towns and ＂ru- ral people＂ from surrounding countryside, which includes the way of thinking by law, perception of organizational and personal relation- ships, the way of settlement after the dispute, and the behavior and quantity of demands to law culture. The way out of conflicts, espe- cially in the common living pattern of ＂community people＂, needs to realize the construction of modern small cities supported from re- source-based small towns as soon as possible, and to transform the identity of ＂unit people＂ and ＂rural people＂ to ＂community peo- ple＂ gradually. Meanwhile, it＇ s required to integrate the civil consciousness of citizen and the patriarchal concept of clansman, to speed up the law popularization work, and to actively spread legal knowledge, thereby forming the supply of legal resources and balan- cing the needs and supply of law. In addition, it＇ s necessary to play the role of particular group, ensuring talent supply for cultivating the residential law culture.
