论食品药品类犯罪的侦查困境与对策

摘　　要：食品药品类犯罪问题日益突出,呈现发案量大、涉案物品种类多且金额巨大,集团化犯罪模式突显,多利用网络销售平台,犯罪数额难以确定,犯罪主体文化程度较低的特点,在侦查工作中出现取证难和审讯难两大困境。必须完善行刑衔接制度、落实侦查提前介入、提高证据保全能力、侦查人员审讯能力和侦查人员执法能力,加强跨部门协作、建立健全常态化协作机制,以有效打击食品药品类犯罪。The increasingly prominent food and drug crimes axe characterized by great number of cases, wide variety of crime-involved articles and huge amount of money, prominent collectivized crime patters, masive use of network sale platform, difficult confirmation of the crime number, and low degree of education on the part of criminal subjects, resulting in difficulties in forensics and interrogation. Acordingly. efforts need to be made to improve the system for connection of executive law enforcement with criminal judicature, implementation of early intervention of investigation, increase evidence perpetuation capacity, investigators1 interrogation ability and law enforcement ability, strengthen cross-department collaboration, establish and improve normal collaboration mechanism so as to effectively crack down food and drug crimes.
