国家公权力监督体系重构背景下的警察权监督

摘　　要：随着国家权力结构的改变和新体制的创建,监察机关的地位得到提升。警察权监督中存在警察行政权和侦查权错位、检察机关对警察权监督力度不够、监督滞后导致监督不达标、上级监督的局限性制约了监督效果和监督方式过于程式化等问题。发挥检察机关的监督作用、建立常态性的定期抽查机制、整体监督和专项监督并重、转变监督管理的思维,才能更好地对警察权进行监督。The change of the state power structure ￡ind the establishment of the new system gives birth to elevation of the status of supervisory organs. Supervision of the police right witnesses malposition of the police administrative right and investigation right, supervisory organs＇ inadequate supervision of the police right, restriction of supervision effects and excessively stylized supervision modes caused by substandard supervision and the limitation of the higher-up supervision.The best supervision of the police right is to play the supervisory role of procuratorial organs, construct a mechanism for random inspections on a regular basis, place equal emphsis on overall supervisions and special supervisions and change the thought of supervision and management.
