摘　　要：本文全面分析了西方"司法独立"的方方面面,包括司法实践实际结果、法官的特权、司法服务对象、"独立"审判权等,特别指出三权分立下的西方"司法独立"实际上捍卫的是资本主义根本制度、核心价值观、根本利益,绝不是其标榜的超然的"司法独立"。This paper analyzes various aspects of Western 'judicial independence,' including the actual results of judicial practice,the privilege of judges,the objects of judicial service and the 'independent ' jurisdiction. It should be particularly noted that what the Western'judicial independence'under the separation of powers really defends is the basic system,core values and fundamental interests of capitalism,rather than the detached 'judicial independence'which the West claims for itself.
