摘 要:为京津冀协同发展提供环境司法保障,要求对生态环境保护案件实行集中管辖。对案件实行集中管辖,首先要确定其根本动因,进而明确其司法改革的方向与目标,再解决其管辖的范围问题,最后扫除其面临的法律、体制等问题。集中管辖的首要动因是回应环境司法去地方保护主义与生态环境整体性保护的需要,而非环境司法专门化。在授权省内高级人民法院对辖区内生态环境保护案件调整并实施集中管辖的同时,设立以流域为基础的专门性流域法院是集中管辖跨京津冀省级行政区划生态环境保护案件的应然选择。The safeguard of environmental justice for the collaborative development of BeijingTianjin-Hebei requires centralized jurisdiction on the cases of ecological and environmental protection. The centralized jurisdiction on cases should firstly clarify the fundamental motivations,and then determine the orientation and objectives of the judicial reform,and further solve the problems of the jurisdiction scope,and finally deal with the legal and systematic difficulties. The primary motivation for centralized jurisdiction should be a response to challenges of removing local protectionism existing in environmental justice and protecting ecological environment as a whole,rather than environmental justice specialization. While empowering the provincial High People's Court to adjust and carry out centralized jurisdiction on the cases of ecological and environmental protection in its jurisdiction,the institution of the special river basin court should be a right choice to mainly impose centralized jurisdiction on the cases of ecological and environmental protection across the Beijing-Tianjin-Hebei.
