摘 要:我国立体车库的财产权性质游离于建筑物、构筑物与设备之间,绝大多数未进行不动产登记,导致开发企业、管理者、业主、消费者多方主体困惑。鉴于立体车库固定于所占地块,利用围合空间,可测算建筑面积,物理界线封闭,宜将其认定为建筑物。参照现行规范,我国立体车库产权登记的主要路径包括:明确立体车库的土地使用权,编制立体车库工程规划,对立体车库工程进行竣工验收,测绘立体车库及其停车位,登记立体车库停车位所有权。The nature of the property right of the mechanical parking system in China is sep- arated from the building, the structure and the equipment. Most mechanical parking systems ha- ven' t been registered as the real estate, which leads to the confusion of the development enterpri- ses, managers, owners and consumers. The mechanical parking system should be identified as a building, because it' s fixed in the occupied land, makes use of enclosed space, can be calculated in the construction area, and its physical boundary is closed. According to the current provi- sions, the main paths of registration of property right of the mechanical parking system in China are as follows: clarify its land use rights, elaborate its project planning, check its construction and completion, survey and draw parking spaces, register its ownership.
