摘　　要：中发[2015]18号文件和新修改的"地方组织法"是探讨乡镇人大闭会期间主席团职权的最高政策和法律依据。乡镇人大闭会期间主席团没有立法权和人事任免权,但是拥有重大事项决定权和监督权,其中又以监督权为核心。乡镇人大主席团的人员构成及组织结构,决定了乡镇人大主席团不能简单地等同于地方人大常委会。在乡镇人大闭会期间行使主席团职权时,要避免弱化乡镇人大及代表个人的作用。Document NO.18 of the Central Government in 2015 and the newly revised local organization law are the supreme policy and legal basis to explore the power of inter-sessional Township People＇s Congress presidium. Inter-sessional Township People＇s Congress presidium has no legislative power or appointment and dismissal power, but it has decision-making power on major issues and supervision power, with supervision right as the core. The personnel composition and organizational structure of Township People＇s Congress presidium decide that it cannot be simply equated to the standing committee of local people＇s congress.During the inter-sessional period, Township People＇s Congress presidium should avoid weakening the role of Township People＇s Congress and representatives while exercising its power.
