摘　　要："文学中的法律"与"作为文学的法律"的关系,涉及法律与文学的核心逻辑,对之深入辨析具有重要意义。"诉讼战场"这一概念是理解两者关系的重要路径,而文学叙事的概念是理解两者关系的重要桥梁。无论是诉讼战场还是文学叙事,其关键在于对"社会细节因素"的调动及与之密切相关的修辞策略,由其获得动能,由其获得存在的必然性,亦由其清晰地展现"文学中的法律"与"作为文学的法律"的互动机制。看到"文学中的法律"与"作为文学的法律"的必然联系,有利于理解法律与文学跨学科研究的学术实践,对法律法学本身同样大有裨益。The crucial logic of Law and Literature refers to the relationship between Law in Literature and Law as Literature,which needs to be speculated deeply. To comprehend the relationship,the concepts of＂lawsuit battlefield＂are meaningful pathand the ＂literature narrative＂is significant bridge. Meanwhile,arranging ＂social detail factors＂and using rhetoric strategy in the battlefield and the narrative are the most important techniques,so that we could find how the battlefield and the narrative obtain the stimulus and emerge their own real inevitability,and so that we could then observe the inherent interaction between Law in Literature and Law as Literature. The speculating is profitable both to the academic practice of Law and Literature and to the practice of law and jurisprudence.
