摘　　要：获取基本医疗卫生服务是公民的生命健康基本权利。本文从《基本医疗卫生法》的立法原因和必要性着手,通过对基本医疗卫生法的概念的重新厘定,明确其内涵和外延;通过对基本医疗卫生法的定位,明确其是社会主义法治体系中起支撑作用的重要法律。从提高立法层次、考虑更多立法主体利益、对新事物要有更多考虑和支持等方面提出建议和意见。Access to basic medical and health services is the basic right to protect health. From the legislative reasons and the necessity of basic medical and health law, this paper redefined the concept of the basic medical and health law, understand its connotation and extension. Through the positioning of the health care law, the basic medical and health law can be considered as the important law playing the important supporting role in the socialist legal system. Taking the level of legislation and the interests of the legislative body as the means, this paper gave relevant recommendations and comments on more consideration and support of new things.
