摘 要:国土资源部公布的《土地管理法(修正案)》(征求意见稿),删除了现行法中禁止集体经营性建设用地入市的条文,为破除城乡二元土地制度打开了法律之门。但没有对试点实践中面临的一些深层矛盾、社会广泛关注的热点问题进行明确回应,在改革的力度与广度上存在欠缺。本文立足试点地区的改革实践提出四个深层问题:一是入市范围界定如何契合我国生产力发展新要求?二是谁来代表集体土地所有权人行使入市权利?三是集体经营性建设用地能否用于商品住宅开发?四是入市土地增值收益分配究竟向谁倾斜?围绕这些问题进行了深入讨论,并有针对性地提出了土地管理法修订建议。The ministry of land and resources of China announced a “land management law (amendment)” to remove the ban on the management of the collective operating construction of land entering the land market. This amendment has the provisions of the existing law, and this action opens the door to eliminate the urban-rural dual structure. But, it is disappointing that this action does not clear some deep contradictions confronted by a pilot experiment, and the societal focus, which greatly reduced the scope and depth of this reform. This paper introduces four problems existing in the reformation process: First, how to defne the entering scopes in order of productivity and development? Second, who will represent the collective land owners to exercise their rights in the market? Third, can collective operating construction lands be used for commercial housing development? Fourth, who will tilt the land increment revenue distribution? These problems are discussed here in-depth, with the hope of proposing amendments to the land management law.
