摘　　要：大型体育场馆项目PPP融资是政府和社会资本合作支持我国大型体育场馆项目的新兴金融路径,其不仅有利于破解"蒙特利尔陷阱",缓解政府的财政压力,还能从根本上推动政府职能转变。建议在《体育法》中对大型体育场馆项目适用PPP融资做出原则性的规定,并制定《政府与社会资本合作法》对PPP融资作顶层制度设计,细化PPP融资的核心法律制度,加强对社会资本方权利的保护。同时改善大型体育场馆PPP项目公司外部融资的法制环境,并建立相应的综合治理法律框架。The PPP financing of stadium projects has become an emerging financial means that thcapital’s support for stadiumprojects. It is not only beneficial to crack “Montreal Trap’’,reduce the pressure on the gov-ernment＇ fiscal,but promotes the changes of governmental functions. Principled provisions for PPP financing of stadium projects should be included in the Sports Law of China,and Public-Private-Partnership Law should be entop-level system design for PPP financing. The core legal system of the PPP financing,should be strengthened to protect the rights of social capital , the external financing legal system environment of the stadium PPP project company should be promoted,the corresponding comprehensive governance legal framework should be established.
